Data"}]},"item_3_biblio_info_7":{"attribute_name":"書誌情報","attribute_value_mlt":[{"bibliographicIssueDates":{"bibliographicIssueDate":"2017-07","bibliographicIssueDateType":"Issued"},"bibliographicIssueNumber":"1","bibliographicPageEnd":"19","bibliographicPageStart":"1","bibliographicVolumeNumber":"63","bibliographic_titles":[{"bibliographic_title":"富山大学紀要.富大経済論集"}]}]},"item_3_description_15":{"attribute_name":"フォーマット","attribute_value_mlt":[{"subitem_description":"application/pdf","subitem_description_type":"Other"}]},"item_3_description_4":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"ビッグデータの利活用の進展に伴って,プロファイリングの精度が飛躍的に向上し,対象者の人物像をよりいっそう詳細に描くことが可能になった。このことにより,プロファイリングは,行動ターゲティング広告や不正検知のための手法として利用されるばかりではなく,人事労務管理の分野にもその利活用が広がりつつある。\n人事労務管理の分野においてプロファイリングを用いると,上司による「主観的」な評価に左右されることなく,「科学的」な分析を通じて労働者の「客観的」な評価を行うことができる,と喧伝されているが,プロファイリング自体に内在する諸問題,つまり,「不可視性」,「脱個人化」,「不確実性」および「脱文脈化」のせいで,求職者や労働者にとって,プロファイリングはプライバシーへの侵害や差別などの重大な脅威になりうる,と懸念されている。\n海外では,プロファイリングの問題性をいち早く認識して,個人情報やプライバシーの保護などの観点から,それに対する法的対応を検討し,実際に法的規制を加える取り組みも見られる。他方,わが国は,プロファイリングの利活用が進んでいるにもかかわらず,海外の状況に比べてほとんど手つかずの状態で,その法的対応の検討すらほとんどなされてはいない。\n本論は,まず,プロファイリングの現状および人事労務管理の分野におけるその利活用を概観して,プロファイリングの利活用が労働者にいかなる脅威を及ぼしうるかを指摘する。次に,懸念される労働者への脅威に対して,わが国の現行法が十分な対応を行えるのかどうかを検討する。さらに,海外(米国および欧州連合)における法的取り組みを踏まえたうえで,わが国における今後の課題を論じることにする。","subitem_description_type":"Abstract"}]},"item_3_description_40":{"attribute_name":"資源タイプ(DSpace)","attribute_value_mlt":[{"subitem_description":"Article","subitem_description_type":"Other"}]},"item_3_description_6":{"attribute_name":"引用","attribute_value_mlt":[{"subitem_description":"富山大学紀要.富大経済論集,第63巻第1号,2017.7,pp.
