Mayor"}]},"item_3_biblio_info_7":{"attribute_name":"書誌情報","attribute_value_mlt":[{"bibliographicIssueDates":{"bibliographicIssueDate":"2017-03","bibliographicIssueDateType":"Issued"},"bibliographicIssueNumber":"3","bibliographicPageEnd":"549","bibliographicPageStart":"517","bibliographicVolumeNumber":"62","bibliographic_titles":[{"bibliographic_title":"富山大学紀要．富大経済論集"}]}]},"item_3_description_4":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"環境法とは，「現在および将来の環境質の状態に影響を与える関係主体の意思決定を社会的に望ましい方向に向けさせるための方法に関する法，および，環境をめぐる紛争の処理に関する法」である。よって，関係主体を構成する諸個人における「これが望ましい方向だ」と思う方向への働きかけが適切に行われ，議論が深められた上での社会的合意がなされることが求められる。よって，そのための示威的行動等を含む意見表明が確保されねばならず，議論の場が確保されることが望ましい。\nしかしながら，住民らの意見表明に対してそれを威嚇するような動きを事業者が取る場合，または事業者の行為が不当に侵害されるような反対運動等が展開された場合等，いくつかの克服すべき課題も見受けられる。本稿は，とくに開発行為の事業者側が原告となって提起する訴訟における，事業者の適切な対応を勘案すべくこれらの課題を検討するものである。\nよって本稿においては，（１）事業者対住民：住民らの意見表明に対してそれを威嚇するような訴訟提起および遂行を事業者側が行う場合，（２）事業者対地方公共団体の長：地方公共団体の長が，その事務執行に当たり，建物建築および販売等を妨害したことには重大な過失があるとして事業者が国家賠償法1条1項等に基づく訴え等を行った場合について検討する。なお，以下で取り上げる事案（２）には，当該地方自治体の条例公布行為の有効性，当該地方自治体の債権行使および国家賠償法1条2項に基づく求償権の不行使等，少なからずの論点が含まれているが，本稿においては，事業者対地方公共団体の長という観点に焦点を当てて扱うこととする。","subitem_description_type":"Abstract"}]},"item_3_description_40":{"attribute_name":"資源タイプ(DSpace)","attribute_value_mlt":[{"subitem_description":"Article","subitem_description_type":"Other"}]},"item_3_description_6":{"attribute_name":"引用","attribute_value_mlt":[{"subitem_description":"富山大学紀要．富大経済論集，第62巻第3号，2017.3，pp.
